Construction Claims

Ronald H.A. van der Steen assists small and medium sized contractors and suppliers with their construction disputes.  Ronald van der Steen is a professional engineer with over 10 years of construction experience (please refer to profile for further details).

The Construction Lien Act allows a subcontractor or supplier to sue the owner of a property for providing improvements to the property even if you do not have a contract with the owner.  The Construction Lien Act is a highly technical and unforgiving statute particularly where it comes to timelines therefore you are advised to seek legal advise as soon as you think you may have a problem.

For example a contractor MUST file its lien within 45 days of performing there last service or delivering supplies to the site.  If the lien is filed on time you MUST then issue your claim within 90 days of performing there last service or delivering supplies to the site (this timeline is inclusive of the initial 45 days).

There are other requirements that must be met to ensure you have a valid lien against the property.
